General Terms of Use

Shopping at home FREE LANCE

  1. Preamble

RAUTUREAU APPLE SHOES, a simplified joint stock company with a capital of 5,297,875 euros, having its registered office at 2 rue des Boutons d'Or 85130 La Gaubretière, registered in the La-Roche-sur-Yon Trade and Companies Register under number 302 640 008, offers a "Shopping at home" service (hereinafter referred to as "the Service") which allows you to make an appointment to visit the site remotely with a FREE LANCE consultant.

For the needs of the present document, "Customer" means any natural person having access to the Service (hereinafter "the Customer").

The purpose of these General Terms of Use (hereinafter referred to as the "GTU") is to define the terms and conditions under which FREE LANCE offers the Service to the Customer.

  1. Scope of the Service

Any use of the Service by the Customer implies full acceptance of these GTU.

The Service as well as the GTU may be modified at FREE LANCE's discretion and without prior notice, and FREE LANCE shall not be held responsible for the consequences of such modifications. It is the responsibility of the Customer to keep informed of any changes that may have occurred in order to know the new conditions of use in force.

  1. The Service

The Service is accessible at the following address https://www.freelance.fr/fr/nos-boutiques

The Customer may:

-        contact a FREE LANCE consultant from Monday to Friday from 11:00 a.m. to 2:00 p.m. and from 3:00 p.m. to 6:00 p.m. exclusively on 0805 385 330,

 

-        make an appointment with a FREE LANCE advisor by selecting a later date and time under "I MAKE AN APPOINTMENT" and filling in your personal information to schedule a call or a Visio via WhatsApp.

The Customer will indicate when making the appointment if he/she wishes to discover particular models.

  1. Obligations of the Customer

By using the Service, the Customer agrees:

-        to declare complete and accurate information when making an appointment with a counselor and update it in case of change,

-        not to use the Service for fraudulent purposes or for purposes not provided for in these GTU,

-        not to impersonate any person or attempt to use a customer account other than their own,

-        not to behave in an inappropriate manner or in a manner that would be perceived as inappropriate by FREE LANCE personnel,

In any event, the Customer is not permitted to record the conversation, take screen shots or broadcast the conversational screens on any electronic or non-electronic medium.

If FREE LANCE personnel become aware of a breach of the Customer's obligations, it may reserve the right to terminate the Customer's access to the Service at their discretion.

  1. Purchase via the Service

Any purchase made by the Customer through the Service implies full acceptance of the FREE LANCE Privacy Policy and the FREE LANCE Terms and Conditions of Sale.

  1. Protection of the personal data

The personal data collected by Rautureau Apple Shoes (hereafter "the Data") within the framework of the access to the Service are compulsory and necessary to allow the functioning of the Service.

Rautureau Apple Shoes is the person in charge of the processing in connection with the Service.

We guarantee to the Customer that no image, video of the Customer will be collected within the framework of the Service.

We guarantee that access to the Service is secure, including that access to live images is protected and that only customers and FREE LANCE staff can access them.

  1. Limitation of liability

FREE LANCE cannot be held liable if the non-performance or misuse of the Service results from a failure by the Customer to meet its obligations set out in the GTU or from a case of force majeure pursuant to Article 1218 of the French Civil Code.

In the event that imperative reasons and/or a fortuitous event occur or in the event of a governmental or administrative decision and/or imperative business decision, including the impossibility of opening the store, preventing FREE LANCE or the Customer from performing its obligations, both must inform each other without delay.

FREE LANCE is not responsible for damages of any kind that may be suffered by the Customer in connection with the use of the Service.

In particular, FREE LANCE shall not be held liable for any technical, hardware or software failure of any kind, the risk of contamination by viruses circulating on the network and the lack of protection of certain data against possible misappropriation.

The use of the Service implies the knowledge and acceptance of the characteristics and limits of the Internet both in terms of technical performance, response times to consult, query or transfer information.

Access to the Service may result in the consumption of part of the data transmission package subscribed to by the Customer with his mobile and/or Internet operator. FREE LANCE reminds the Customer that any use of the Service outside of Metropolitan France is likely to result in costs considerably higher than those of use from France. The Customer is solely responsible for obtaining the relevant information and paying any charges, including roaming charges, invoiced by the Customer's operator.
